Terms & Conditions

Please Read Carefully:
The purchase of any travel services offered by All Asia Tours constitutes a contractual arrangement between you (the client) and All Asia Tours, and represents your acceptance of the All Asia Tours Terms & Conditions set forth herein. Please make sure that you carefully read and understand the Terms & Conditions prior to booking. If the person making the reservation is doing so on behalf of a party, then that person must have the authority to accept these Terms & Conditions on behalf of the entire party. In addition, (s)he is responsible for ensuring that each party member is kept fully informed of all reservation details at all times.
 
General
You are advised to check our website or to request the latest version of the Terms and Conditions from All Asia Tours or your Travel Agent prior to booking. No variation of these Conditions shall apply unless confirmed in writing by or on behalf of All Asia Tours. These Conditions together with the All Asia Tours' Confirmation Invoice constitute the whole agreement between the parties and supersede any prior promises, representations, undertakings, or implications whether written or oral.

Itineraries
All Asia Tours reserves the right to change any programed itinerary including arranged sightseeing and accommodations such as cruise ships, aircraft, and trains at any time due to unforeseen circumstances and/or circumstances outside of All Asia Tours' control. We will make every effort to operate the itinerary as originally planned, but unavoidable alterations may occur even after the final itinerary has been issued.

Accommodations
Both packaged group tours' and custom tours' prices are calculated based on the assumption that 2 travelers will share a twin or double bedroom. At All Asia Tours, we will try our best to have your preferred room type (such as a twin bedroom, double bedroom, or triple bedroom), but we cannot guarantee the bed arrangements. The bed arrangements are up to the hotel's discretion upon check- in. Most hotels' check-in times occur during the late afternoon, and check-out typically takes place in the morning. If you wish to check-in immediately upon arrival or check-out at a later time after the regular check-out time, we can arrange these conveniences for an additional charge. Air Transportation
International airfare (including the arrival flight to the tour and the final departure flight) is not included in All Asia Tours' packaged tours or the quoted itinerary price. However, All Asia Tours can offer quotations for your international flight at any time. All international flight quotations and availability of flights are subject to change until the payment for your airfare has been made. Some packaged tours include internal flights as specified in the itineraries, and in such cases, airfare is included in the tour price. All internal flights are based on economy class. All flight reservations are based on availability and cannot be confirmed until both a passport copy and payment have been received. Please note that most international and internal airfares are non-refundable, non-transferable, and non-changeable (some exclusions apply).

Passports and Visas
All destinations require you to obtain a passport which is still valid for 6 months after the return date from your trip, as well as a blank visa page for immigration stamps for each country you will visit. In addition, you may need a visa for your destinations. It is your responsibility to obtain a valid passport and have the appropriate travel documents with you whenever they are needed. For U.S. passport holders, All Asia Tours will notify you whether or not you need a visa during your reservation process. Reservation and Payment

Currency
The Price shall be payable in the invoiced currency (we cannot accept payment for a single booking in multiple currencies).

Deposit
A non-refundable deposit of $500 (USD) per person must be remitted in order to process your reservation. The deposit payment applies to land packages only; air travel will be purchased separately.

Payment
The full price of the tour shall be paid within 3 days of receipt of the Invoice. When the booking is made more than 60 days in advance of the Departure Date, a non- refundable Deposit of $500 (USD) per person shall be paid upon booking, and the remaining balance must be paid in full no later than 60 days prior to the Departure Date. Regarding the selected tours listed below, final payment must be made no later than 100 days prior to the Departure Date. If booking occurs later than 60 days (100 days for selected tours) before the Departure Date, the full tour price shall be paid within 7 days of receipt of the Confirmation Invoice.

Selected tours: The Best of Myanmar and Inside Myanmar

Time for payment shall be of the essence. No payment shall be considered received by All Asia Tours until we have received cleared funds.

Price
Once we have issued your Invoice, and subject to us having received the deposit payment or payment of the full price, there will be no changes made to the price of your vacation. It is your responsibility to check that the details of the Invoice are accurate. Any additional requests not included on the Invoice do not form part of the Contract.

Cancellation Policy
The following is the All Asia Tours' group tour cancellation policy*:
*This cancellation policy will not be applied to custom- made trips. Exceptions to the cancellation policy apply for custom trips, and you will be notified of these at the time of booking.

You may cancel the Reservation in writing at any time. If you cancel the Reservation or fail to pay the price in accordance with the payment terms above, All Asia Tours reserves the right to charge cancellation fees per person as follows:

Group Tours (except the following tours listed below):
61 days or more before Departure Date: $500.00
60 days to 46 days before Departure Date: 50% of the tour price
45 days to 31 days before Departure Date: 75% of the tour price
30 days or fewer before Departure Date: 100% of the tour price

The Best of Myanmar and Inside Myanmar:
101 days or more before Departure Date: $500.00
100 days to 81 days before Departure Date: 50% of the tour price
80 days to 61 days before Departure Date: 75% of the tour price
60 days or fewer before Departure Date: 100% of the tour price

Partial Room Cancellation
When one guest cancels a tour and a roommate remains, a single supplement will be applied to the price for the remaining guest.

Cancellation of Extra Services
Additional services such as pre/post-hotel nights and extra services connected with All Asia Tours itineraries are subject to a cancellation penalty. Customers will be notified of the details of the policy at the time the travel arrangements are made.

Issued Flight Ticket Cancellation
Note that additional cancellation fees may apply for airfare. If you purchase international or domestic flights with All Asia Tours, please be aware that the tickets are usually issued immediately by us upon receiving your payment. If you cancel the Reservation after the date that the tickets are issued, in most cases, the airline will impose cancellation charges which usually constitute the full cost of the airfare. All Asia Tours will advise you of these charges before cancellation. These cancellation charges will be passed on in full and are in addition to any other cancellation charges (as specified above).

Custom Tour Cancellation
If you wish to cancel your travel arrangements, all cancellations must be received in writing. The cancellation fees vary, depending on the custom tour. All Asia Tours will notify you of the cancellation policy when you request to make a custom tour reservation.

Cancellation Date
The cancellation date will be the date on which All Asia Tours receives the written notice of cancellation. The cancellation goes into effect on the date that the email, fax, or letter is received.

Changes to the Reservation 

Group Tour Land Package
If you wish to change the Reservation to a later departure date, or if you want to transfer the Reservation to another person following receipt of the Invoice, then All Asia Tours may -- at its sole discretion -- agree to such changes, which are subject to an administrative fee of $50.00, plus an internal flight and/or cruise cancellation fee, if applicable. Additionally, we reserve the right to make any further changes as necessary, related to the changes made in advance by the client/traveler.

Requests for Reservation changes and transfers must be made in writing 60 days or more before the Departure Date. If you decide to change and/or transfer the Reservation fewer than 60 days before the Departure Date, this will be treated as a cancellation.

Issued Flight Tickets
If you purchase international or domestic flights with us, please be aware that the tickets are usually issued immediately once we receive your payment. Changes to flight tickets are subject to airline-imposed fees or penalties. Similar to cases where airline tickets are canceled, most airline tickets cannot be changed after purchase.

Limited Responsibility
All Asia Tours is an independent company (henceforth known as “the Company”) that arranges for the vacation services offered on its website including transportation, sightseeing, and accommodations, through independent contracts.

Air carriers, accommodations, and other suppliers (including but not limited to trains, cruises, ferries, motor coaches, hotels, and restaurants) that provide services are independent contractors and are not agents, employees, servants, or joint venturers of the Company or its affiliates. All certificates and other travel documents for services issued by the Company are subject to the Terms & Conditions specified by the supplier, which are available upon request, and to the laws of the countries in which the services are supplied.

The international carriage of passengers is subject to international conventions and treaties, where applicable. These international agreements limit and, in some events, exclude the carrier's liability to passengers (henceforth known as 'Tour Participant(s),' 'You,' or 'Your'). Where any claim or part of a claim (including those involving death or personal injury) concerns or involves any travel arrangements (including the process of getting on or off the transport concerned) provided by any air, sea, inland waterways, rail, or road carrier, or any stay in a hotel, the Company's maximum liability is the maximum which would be payable by the carrier or the hotel keeper concerned under the applicable international convention, treaty, or regulation applicable to the travel arrangements or hotel stay in that situation.

After departure, if the services included in the Tour cannot be supplied, or there are changes in an itinerary for reasons beyond the control of the Company, the Company will arrange for the provision of comparable services. Any resulting additional expense will be the responsibility of Tour Participant(s), and any resulting savings will be refunded by the Company to the Tour Participant(s).

Any liability in respect of transportation failure, including but not limited to: delay in the Tour Participants' outward or inward flight/s, whether the cancellation or delay is caused by the weather, airline rescheduling, industrial action, or mechanical failure. The Company will give no refunds or compensation for lost time and services from the itinerary due to delayed or cancelled flights or delayed or cancelled public buses, trains, or other forms of transport included in Your itinerary.

When booking the Tour, the Tour Participant(s) accept responsibility for personal proper conduct and the proper conduct the Tour Participant's party during the entire duration of Tour. The Company will not be liable to You if You cannot complete the Tour as a result of the behavior of You or Your party during the Tour, in particular but not limited to: an airline considering You or anyone in Your party unfit to travel. You agree to indemnify the Company against any claims, losses, demands, costs, and other expenses which the Company may incur as a result of any damage to property, person or accommodations, being refused travel, or diversion of Your flight as a result of the behavior of You or Your party.

The Company reserves the right to accept or reject any person as a Tour Participant; to expel any Tour Participant from the vacation; to make changes in the itinerary whenever the Company deems it necessary for the comfort, convenience, or safety of the Tour Participants; and to cancel a tour at any time.

The Tour Participant agrees that neither the Company nor its affiliates shall be liable for any damage, loss (including personal injury, death, and property loss), or expense occasioned by any act or omission of any independent contractor providing services, any insurer or insurance administrator under the Travel Protection Plan, or for any other person.

The Company shall not be liable for, nor be in breach of, these Conditions for any delay in the performance or any non-performance of the Company's obligations under the Contract if the delay or non-performance is due to a circumstance(s) beyond the reasonable control of the Company, including but not limited to acts of God, war or threat of war, terrorist activity, riot, civil strife, industrial dispute, natural or nuclear disaster, fire, or adverse weather conditions.

Arbitration against the Company must be commenced within one year following the date of tour completion. Neither the Company nor any affiliate shall in any case be liable for other than compensatory damages, and You hereby waive any right to punitive damages.

Insurance
You must take out insurance for medical and personal accident risks (including the cost of emergency repatriation) and have adequate baggage coverage. All Asia Tours can recommend travel insurance services, such as Travel Guard. Please note: obtaining travel insurance is solely Your responsibility.

Passports, Visas, and Health
The Tour Participant is responsible for ensuring that all members of his/her party are in possession of a valid passport and a visa for the countries in Asia that will be visited. In addition, the Tour Participants are responsible (where applicable) for making sure that all inoculations have been carried out and health certificates are available. If you have existing medical conditions, You are advised to visit a doctor well in advance of departure. All Asia Tours will offer such assistance and advice in obtaining visas and Permission as much as possible, however, All Asia Tours cannot – under any circumstances – be responsible if You or the members of Your party are not granted a visit or permitted entry into a country or countries in Asia. If such a refusal occurs and You cancel the Tour, then the Cancellation Policy shall apply.

Complaints
In the unlikely event that You have a complaint, then You must immediately report the complaint in writing to the Company or to the Company's local representative. Subsequently, You must provide supporting evidence (in writing) to the Company within 30 days after returning from the Tour. If appropriate, You must take all reasonable steps to minimize the consequences of the problem. Your failure to give the Company the opportunity to resolve the problem while on the Tour in accordance with this clause may reduce Your rights under the Contract.

Definitions

Company:
All Asia Tours, a company registered in the state of California, CST #2102781-40 whose corporate office is located at 337 N. Vineyard Ave Suite 215, Ontario, CA 91764, USA.

Confirmation Invoice:
The invoice received by you following the Reservation, which confirms the details of the Contract.

Contract:
The contract for the provision of the Tour made between the Company and You.

Departure Date:
The start date for the Tour as specified in the Confirmation Invoice.

Reservation:
The written request from you to the Company for provision of the Tour.

Tour:
The specific tour package or vacation services provided by the Company in accordance with these Conditions.

Tour Participant(s)/You/Your:
The persons, firm, organization for whom the Company has agreed to provide the Tour.
